Supes nix request

The Cochise County Board of Supervisors voted unanimously to deny a request for a road easement abandonment that cuts between two 40-acre parcels off Portal Road in Three Triangle Ranches Unit VI.

During the Oct. 2 meeting, Patricia Morris, acting county highway director, said the abandonment was opposed by a property owner whose plot could be accessed from the future road if it is ever constructed.


David Kuchner, the opposing owner, told the highway office that he does not want to eliminate any possible access routes to his property since he may choose to split or develop his parcel. His parcel was purchased with the intent to do so at some point in the future.

Matthew and Ann McKenzie, owners of lot 144, and William McClure, owner of lot 143, had already received a partial abandonment giving them 15 feet on either side of the 80-foot easement through a request that was approved by the supervisors earlier this year. The owners requested the abandonment to make their property more marketable if they choose to develop or split it.

Morris recommended the abandonment be denied.

"I can see that this is a right of way that could reasonably be abandoned," board Chairman Richard Searle said. "But Mr. Kuchner bought the property with the knowledge of the right of way being there. So, it doesn't make sense to abandon it."

Supervisor Paul Newman suggested more information should be gathered to determine ingress and egress to various properties. He also said a community plan for the Portal area should be devised.

The board also approved a resolution authorizing the Cochise County treasurer to collect property taxes as indicated on the 2007 tax roll and to perform all other actions relating to the proper receipt and disbursement of these funds. The supervisors have to give approval every year.

The supervisors also approved a grant agreement between Arizona Criminal Justice Commission and the county for the fiscal year 2006-07 for $272,072. The grant funds two drug crime attorneys and two senior legal secretaries in the Cochise County Attorney's Office. During that year, the grant-funded attorneys were assigned 189 defendants and indicted 118 defendants. Those cases would have gone unprosecuted without the grant funds.
