Thieves ordered to repay $47,286

The two teenagers responsible for causing nearly $50,000 in damage to local convenience stores were ordered to pay restitution and sentenced to four years probation.

Rey Alfonso Ramirez and Preston Allan Havener have been ordered to pay $47,286 for the damage caused in a July 2009 burglary at the Junction Express Food Mart off State Route 80 in Benson.

The 18-year-olds have also been sentenced to four years probation after they pleaded guilty to two counts of third-degree burglary, criminal damage, and trafficking in stolen property.


Ramirez and Havener did not receive additional jail time with each credited with 172 days time served.

According to the Benson Police report, on July 12, 2009, officers were dispatched to the SR-80 convenience store where they observed serious damage to the door and front window.

The officer's statement said the door appeared to have been smashed in with a baseball bat.

The suspects also damaged the store's cash registers and credit card machines, and the coffee and soda machines were destroyed.

The damage was consistent with a break-in that occurred earlier that morning at the Chevron gas station /convenience store on N. Ocotillo Road.

Like Junction Express, besides a lot of damage, the suspects stole money and tobacco products.

Besides the cost of repairs, Junction Express owner Theresa Bennett estimated that having the store closed for several days for cleanup caused a $9,000 loss in business.

After the initial investigation, police took Ramirez and Havener into custody for previous robbery attempts.

After reaching a plea agreement with the Cochise County Attorney's office, Ramirez and Havener were ordered to pay monthly payments of $550.

The four-year probation terms began on Dec. 31.

" Why are they being so tough on these youngsters? These businesses have insurance to pay for the damage. Boys will be boys. A few hours of community service would be plenty. They don’t have jobs so how can they pay? Just drop the fine. These kids were locked up for 171 days so why do they need to serve a probation period? Being on probation may make them miss Spring Fling. Give them a break. "

" They are youngsters, yes. Sure, they need to mature a LOT more. This isn't just boys will be boys though. They did serious damage to someone else's property.
They may miss Spring Fling?? They're lucky they weren't locked away for longer! In some countries, if someone steals something, they cut off their hand. I'm NOT suggesting that this happen to them at all, but using it as an example. It would be better for these boys to do community service, and learn how to be productive members of society, instead of vandals. "

" Rey has matured alot. He is currently doing 100 hours of probation, trying to get his G.E.D, looking for a job and spending time with me, which keeps him out of trouble and keeps him on track. Rey was pressured into doing this crime by peer pressure. Rey did refuse at first to do the damage they did. Besides Rey has changed alot. He has my help through all of this. Even visits to his probation officer. Rey is working on changing his life around with me by his side. "
